Ethical and Legal Implications for Artificial Intelligence in Law

This chapter focuses on the question of ethics and legal considerations based on the involvement of artificial intelligence (AI) within legal frameworks. It discusses whether the ethical aspects of work on AI technologies, specifically their operational effectiveness, should be considered alongside the basic moral concepts of two types of ethical theories included in this research: consequentialism, as well as deontological or categorical ethical theory models. It also addresses the integration of AI systems into the practice of law from both ethical and legal viewpoints within the scope of human rights protection. Comparably, it investigates AI’s ability to challenge certain aspects of the law, such as fairness, accountability, transparency, and the overall process of law. By analyzing AI within various international legal frameworks, this chapter seeks to highlight the challenges of bias in algorithms, data privacy, and breaches of human rights. It is essential to integrate ethics into AI systems in such a way as to still allow human oversight while allowing AI to be both intelligent and effective.
