Autopoietic Co-Evolution of AI and Law

The interaction between Artificial Intelligence (AI) and Law is not merely a linear process of adaptation and regulation. This phenomenon can be described through the lens of autopoietic evolution, a concept rooted in Systems Theory. Autopoiesis, originally a biological term, refers to systems capable of self-generation and self-regulation. When applied to the legal system and AI, autopoiesis captures the idea that both systems are self-referential and mutually influencing each other's evolution. This chapter explores the autopoietic co-evolution of AI and Law, discussing how the legal system shapes AI development and, conversely, how AI transforms legal governance.
