INTELLECTUAL PROPERTY RIGHTS OF ARTIFICIAL INTELLIGENCE: THE PERSPECTIVES OF INTERNATIONAL LEGAL AND DOMESTIC REGULATION

Національний університет «Одеська юридична академія»У статті розглядаються історичні аспекти становлення та розвитку права інтелектуальної власності в період до ХХ століття.Цей розвиток, який відбувався переважно в межах окремих держав та їхніх правових систем, сприяв формуванню важливих понять і базових концепцій, що лягли в основу подальшого міжнародно-правового регулювання прав інтелектуальної власності наприкінці досліджуваного періоду, а також у ХХ столітті.Таким чином, йдеться про доміжнародний етап розвитку права інтелектуальної власності.Особлива увага наголошується на тому, що розвиток права інтелектуальної власності завжди перебував у тісному взаємозв'язку з науково-технічним прогресом, що показано у статті на прикладі правового регулювання окремих питань: зокрема, появи знакових систем у давнину, бурхливого розвитку нових інститутів права інтелектуальної власності з виникненням книгодрукування, а також формування сучасної системи уявлень про інтелектуальну власність у період промислової революції ХІХ століття.Це дозволяє автору дійти висновку, що нова революція в інтелектуальній діяльності, пов'язана із появою штучного інтелекту та його активним проникненням в усі сфери людського життя, повинна неминуче призвести до не менш радикальних змін у правовому регулюванні прав інтелектуальної власності, в тому числі й на міжнародному рівні.У статті розвиток права інтелектуальної власності досліджується на конкретних прикладах його нормативно-правового регулювання: починаючи з появи окремих норм-звичаїв, поодиноких законів, до виникнення систем регулювання цілих інститутів (наприклад, книгодруку), аж до сучасного комплексного регулювання права інтелектуальної власності.Цей розвиток розглядається у взаємозв'язку як процес, що, з одного боку, був явно поступовим -кожне наступне досягнення спиралося на попередній досвід, а з іншого -кожний новий етап характеризувався появою принципово нових характеристик права інтелектуальної власності, що раніше були невідомими.Нагромаджений історичний досвід дозволяє стверджувати, що формування нового етапу правового регулювання інтелектуальної власності буде можливим із використанням існуючого категоріального апарату, проте потребуватиме його адаптації до принципово нових умов або ж навіть розробки нових термінів, які б належним чином характеризували новостворені інститути.Ключові examines the historical aspects of the formation and development of intellectual property law in the period up to the 20th century.This development, which took place mainly within the framework of individual states and their legal systems, contributed to the formation of important concepts and concepts that formed the basis of international legal regulation of intellectual property rights at the end of the period under study, as well as in the 20th century.Thus, we are talking about the pre-international stage of development of intellectual property law.It is emphasized that the development of intellectual property law has always been closely related to scientific and technological development, which is shown in the article on the example of legal regulation of certain issues with the emergence of sign systems in antiquity, the rapid development of new institutions that now form part of intellectual property law, with the emergence of printing, the formation of a modern system of ideas about intellectual property during the industrial revolution of the 19th century.This leads the author to the opinion that a new revolution in intellectual activity, associated with the emergence of artificial intelligence and its penetration into all spheres of life, must certainly lead to no less revolutionary changes in the legal regulation of intellectual property rights, including at the international level.The article examines the development of intellectual property law on specific examples of its regulatory and legal regulation, starting from the emergence of individual norms and customs, through individual laws, to the emergence of a system of regulation of entire institutions (for example, book printing) and to the modern regulation of intellectual property law as a complex legal system.This development is considered in its interrelation as such, on the one hand, as being clearly gradual, that is, each subsequent achievement did not arise from nowhere, but was based on previous developments, and on the other hand, each new stage should be considered as revolutionary and characterized by the emergence of fundamentally new characteristics of intellectual property law that were not known before.The experience gained allows us to assert that the formation of a new stage of legal regulation of intellectual property is possible using the existing categorical apparatus, but it will require its adaptation to fundamentally new conditions, or the invention of separate new terms that would characterize its newly created institutions.
