This Chapter deals with the concepts of design and design liability, particularly in the context of BIM projects. The important issues of Intellectual Property Rights and Copyright considered when BIM applies is also dealt with. The interaction between Artificial Intelligence and Intellectual Property Rights is also discussed, and also the types of warranties and indemnities that may be required are considered. This chapter also considers the matter of insurance requirements, and notes that this is presently a matter that is of concern in the BIM community.
