Exploration of IHRL principles in AI domains within the Indian landscape

The rapid advancement of artificial intelligence technologies has brought forth complex challenges and opportunities, particularly pertaining to human rights. This paper aims to explore the intersection of International Human Rights Law (IHRL) principles and AI domains. At the center of this exploration lies the examination of how AI technologies impact fundamental human rights enshrined in IHRL frameworks. Through an analysis of the Indian legal framework, including laws, regulations, policies, and judicial decisions, the paper assesses the extent to which existing legal mechanisms address human rights concerns in the context of AI domains. Key IHRL values like responsibility, openness, justice, non-discrimination, and human dignity are scrutinized in light of their relevance to AI governance. The paper delves into the consequences of these principles for the development, deployment, and regulation of AI technologies in India, aiming to identify gaps and obstacles that may arise. It examines the result of these challenges on various human rights, such as the entitlement to privacy, freedom of expression, due process, and the right to an impartial trial. By identifying opportunities for integrating IHRL principles into AI governance frameworks, the paper aims to contribute to the promotion of ethical AI deployment and safeguarding human rights in India.
