Criminal Liability for Artificial Intelligence Crimes

The discourse surrounding crimes involving artificial intelligence (AI) has become a pressing issue due to the legal challenges these crimes pose, particularly concerning the criminal liability of perpetrators. Despite the numerous advantages AI offers, it presents significant challenges, chief among them being the capacity of current legislation to accommodate the unique characteristics of this technology. Additionally, there is the challenge of investigations in proving the perpetrator’s intent and awareness of the legal consequences of their actions. Given the importance of this topic, the research problem is outlined as follows. Research Problem The research problem can be summarized in three questions: 1. To what extent is legal and criminal liability applicable to acts committed through artificial intelligence? 2. Given the complexities of identifying the party responsible for AI-related crimes, how can the legal framework be developed to determine criminal liability for such crimes? 3. What are the criteria that should be applied to establish criminal liability for artificial intelligence? Research Significance The significance of this research lies in highlighting the current challenges posed by AI systems amidst the rapid pace of technological advancement. It aims to examine the system of criminal liability arising from AI, by shedding light on its causes and specificities in this field. Research Methodology The research will adopt a descriptive-analytical approach, analyzing the legislative framework for AI-related crimes within criminal legislation and evaluating its effectiveness in deterring such crimes.
