Is Turkish Copyright Law Well-Equipped to Handle Artificial Intelligence?

This chapter provides an overview of Turkish law as regards the most-frequently debated copyright problems within the realm of artificial intelligence. The problems which are observed to be the most prominent are probable copyright infringements in the training and testing phase of AI, copyright infringement as a result of the output of AI, and copyright protection of AI outputs. Although these copyright issues can be observed in various AI applications, they are more pronounced in generative AI. The success and wide reach of OpenAI's ChatGPT revealed that the question which needs the most urgent answer was not “Will robot kill us and who will be liable?” This is not to undermine the need for clarity for AI involved accidents, but copyright problems emerged more widely and have already been subject to lawsuits, especially in the US. Global use of Generative AI makes the copyright problems relevant for all jurisdictions. However, Turkish copyright law has not been amended accordingly yet. This chapter displays at which points Turkish law falls short and propose changes, where needed.
