An Evaluation on the Legal Entity of Artificial Intelligence and Intellectual Property in Turkish Law

The changing world order undoubtedly leads to a transformation in the rule of law. However, it is usually not possible to ensure synchronization between the two systems in terms of speed and change during this transformation. The development of artificial intelligence, its effects, problems, and question marks have led to the emergence of new and different discourses within legal systems and revealed many legal gaps. The first and most important question and problem is undoubtedly who can own the property of the work produced by artificial intelligence and whether artificial intelligence should be considered a person. This discourse is reminiscent of the debates in legal context during the surfacing of the legal entity concept. This study will first discuss the notion of artificial intelligence, then outline the work, owner of the work, and intellectual rights within the scope of Turkish Law of Intellectual Property Rights; focus on the notion of individual and types of individuals, as defined by Turkish Civil Code; and will lastly make an overall evaluation on artificial intelligence.
