FEATURES OF THE TRANSFER OF COPYRIGHT OBJECTS INTO THE PUBLIC DOMAIN

The article is devoted to the peculiarities of the transfer of copyright objects to the public domain. It was determined that the public domain is one of the main elements of the copyright protection system, which is based on the balance of interests of creative people, creators of various copyright objects, as well as users and society as a whole. Works that are not protected as objects of copyright due to the expiration of the property copyright on them are considered public property. And also works that are not protected by copyright. The legislative practice of foreign countries distinguishes the following ways in which works fall into the public domain: expiration of the copyright term; non-fulfillment of copyright renewal rules by the copyright owner; the intentional placing of a work in the public domain by the copyright owner, known as "dedication"; copyright law does not protect these kinds of works. The authors came to the conclusion that the public domain is all works and objects of intellectual property whose copyright has expired with the consent of the author or after a certain time after his death; such works belong to the public and not to the individual author or artist; anyone can use a public domain work without permission, but no one can ever own it. Public domain status will allow anyone to create products with heroes and make a profit from it.
