Endorsing Trust in Digital Engineering: Accredited Electronic Certificate and Their Reliability in Engineering Transactions

This study aims to evaluate the trust certificate service providers emerged, as a neutral party mediating between the competent administrative body that grants the license and accreditation to the provider, and the public dealing with these electronic means, or what are called subscribers, so it was necessary to search in depth into the legal organization of the trust certificate service provider in light of the Electronic Communications and Transactions Law of 2018. The main findings of this study revealed that the legislator in the Electronic Communications and Transactions Law stipulated that trust service providers must obtain the necessary license from the competent administrative authority before practicing the activity, while the UNCITRAL Model Law on Electronic Signatures did not stipulate this. The legislator has recognized the validity of the authentication certificate issued by the trust service provider as long as it meets the requirements specified by a decision issued by the competent authority. This study recommends to include allows trust certificate service providers to disclose personal or financial information if there is written consent or in implementation of the provisions of the law.
