Party banning in Israel

On 23 July 2023, the Knesset (Israel’s parliament) passed a highly controversial legislation that undid the Supreme Court’s ability to overturn a government decision on the basis of ‘unreasonableness’, only to have this legislation abolished by the Supreme Court on 1 January 2024. Since the 1960s, Israel has barred political parties from participating in the national parliamentary elections. This article places these bans in historical and theoretical context in an attempt to demonstrate how they were carried out and on what grounds, with a special emphasis on the relationship between the legislature and the Supreme Court.
