The Legal Regime of Cyber Body Parts: The Present and the Future

Elena V. Khamidullina · JURIST · 2023

The study is devoted to identifying the legal nature of cyber-body parts, which are qualified by the authors as an object of civil rights. The article defines their place in the system of objects of civil rights and distinguishes them from related phenomena (human organs and tissues, bioprint technologies, robots). Comparison of cyber-parts of the body with other objects according to the coincidence of their characteristics and analysis of the admissibility of referring cyber-parts of the body to such objects as things, other property, results of intellectual activity, human organs and tissues, and some others have been carried out. Also, some moral and ethical aspects on which the legislation on cyber parts of the body should be based are analyzed and proposals are made for its improvement. As a result, it was concluded that the cyber-parts of the body are not completely identical with the considered objects of civil law and the need to allocate them to a new category of quasi-things within the framework of other property.
