EMOJI AS CRIMES: TYPOLOGY AND QUALIFICATION ALGORITHMS

The article offers a systemic approach to the determination of criminal law attributes of emoji as digital symbols of network communication. Referring to the evaluation of their role in the genesis of the criminal conduct, the author singles out three emoji groups: emoji as crime facilitating instruments, emoji as threats and emoji as calls for illegal actions. An analysis of criminal cases is used as a basis to list emoji illegality criteria and develop crime qualification algorithms.
