Criminal confrontation of the crime committed via an automated robot in Libyan and Emirati law

Today's world is witnessing an important development in telecommunications, information technology and computers that has resulted in what are known as automated robots as one of the most important applications of artificial intelligence and has increased reliance on them in various areas of life for the importance of the services they provide to humanity. However, such robots may be used to commit an offence and the study therefore aims to determine the effectiveness of legal texts in the face of the offence from which they may occur. The study required an analytical and comparative approach by analysing and comparing the texts in question to identify weaknesses in achieving an effective response to robot crime. The study found that current texts were ineffective in providing an effective response to robot crimes in the absence of conditions for criminal liability against the robot, While there is no explicit provision for countering robot crimes in Libya's cybercrime law, article 54 of the Law on Combating Rumours and Cybercrime in the United Arab Emirates provides for countering the crime committed via robot by criminalizing the act of creating or modifying a robot for the purpose of committing an offence, it does not accommodate all offences, as it is limited to the offence of publishing or circulating data and news. The study has shown that robots can commit crimes other than the previous one. In contrast, the Libyan legislator, despite the novelty of Act No. 5 of 2022 on cybercrime, omitted to criminalize the act of creating or modifying a robot to commit an offence. The study therefore recommended criminalizing the act of establishing or modifying an automated robot to commit any offence or subsequently deleting an automated robot, with aggravating punishment in certain cases when committed by an information technology specialist, a public official and other cases in the study.
