AI and Its Application in Criminal Investigation

There are several problems with the use of AI within the scope of criminal law, which the authors will not address in order not to escape the core of this chapter, but which are essentially related to how to criminalize actions carried out by computer software. Is the aforementioned software eradicated, as a “capital punishment”, repairing the evil it committed or could its creator be held criminally liable for the acts that resulted from its creation? Therefore, the authors analyze the use of AI in criminal investigation and the possibilities offered by its use in the analysis and detection of profiles in organized crime, such as in the prevention and investigation of terrorist events, among other situations.
