DIAGNOSIS, PROCESS FLOW AND BLOCKCHAIN SUPPORTED CHAIN OF CUSTODY FOR SUBPOENAING TELEMATIC DATA IN BRAZILIAN CRIMINAL INVESTIGATIONS

The criminal investigation, after the digital revolution, began to work with criminal evidence from the most diverse technological sources, often requiring legal measures to obtain them from technology companies and their cloud data storage. In this work, we describe some of the main difficulties involved in the management of digital evidence from law enforcement subpoena, focusing on its pre-processing (acquisition, organization, data storage) and on chain of custody integrity. The work was supported by institutional diagnostic research and bibliographic research. The results allowed inferring some conclusions that corroborate the practical scenario. There is no similar routine among the various law enforcement professionals, each one in their work group will perform the task in a similar way, but not in a standardized way. A Web platform architecture based on blockchain technology was proposed to improve the life cycle and use of subpoenaing telematic data in the police investigation environment.
