With this in mind, a useful place to start is to look at the legal issues that any potential acquirer or investor in a data centre provider will want to consider in the context of its legal due diligence. The business models supporting data centres range from owner-operator or single-tenant models through to colocation providers, fully managed hosting, and cloud-based services. Most of these models require a different approach to commercial contracting. Limited recourse finance structures are attracting specialised infrastructure investors who see opportunities for sustainable returns from the data centre market. Not unexpectedly, data centre procurement and construction considerations vary depending on location, scale, complexity, and market demand.
