Perspectives on digital regulation

Data is the pinnacle of the digital economy, which has fuelled amazing innovations in all sectors of the economy. However, the accumulation of data in the hands of a few global companies may lead to a number of unwelcomed issues such as lock-in, bottleneck issues and leverage. This has been recognised by the various reports on competition in the digital sector published the last two years in multiple jurisdictions. This chapter consider these reports, which almost all suggest some form of change to the regulatory landscape to address the novel challenges posed by the digital economy or at least a resuscitation of antitrust enforcement. Some of these changes can happen within current powers, but some requires ex ante regulation to ensure a level playing field.
