This chapter focuses on the practical aspects of copyright law in Israel. It begins with an overview of the theoretical foundation for justifying copyright law in Israel, along with the statutes governing Israeli copyright law and international treaties implemented in Israeli copyright law. It then turns to a discussion of the threshold for protected “work,” originality, self-creation, creativity, the “sweat of the brow” doctrine, and the fixation requirement. It also examines the kinds of works that are protected by copyright, what constitutes a “substantial” part of the copyright work, copyright infringement, and kinds of uses of copyright works that are permitted. Finally, the chapter tackles defenses and remedies in infringement proceedings.
