Placing AI within the IP law map

Aviv H. Gaon · Edward Elgar Publishing eBooks · 2021

While chapter four explores the different intellectual property theories, reflecting on their underlying bases, this chapter places the artificial intelligence discussion within the intellectual property theoretical map and proposes a broader perspective for AI-IP theory. In doing so, chapter six extends the theoretical debate, signalling relevant elements from the different intellectual property theories and considering whether artificial intelligence might be explained by or applicable to those theories. The goal of this chapter is twofold: First, discussing if one or more legal theories can recognize the creations of artificial intelligence; second, returning to the theoretical discussion and considering if legal assumptions can adapt to recognize artificial intelligence authorship or inventorship.
