VACCINATION AGAINST COVID-19: THE RIGHT OR OBLIGATION UNDER THE UNDERSTANDING OF THE EUROPEAN COURT OF HUMAN RIGHTS

з обов'язковою вакцинацією та відстороненням дітей від навчання у зв'язку з відсутністю в них щеплень.Актуальність теми дослідження зумовлена насамперед тим, що за останні декілька місяців досить відомі національні й міжнародні судові установи почали виносити рішення, пов'язані з вакцинацією населення.Можливо, такий стрімкий розвиток судової практики в такому питанні можна пов'язати з поширенням епідемії коронавірусу й появою відповідної вакцини.Основна увага в дослідженні приділяється практиці Європейського суду з прав людини.Зокрема, проводиться аналіз як застарілих рішень Європейського суду з прав людини, так і більш сучасних.Окрім цього, в роботі акцентовано на відповідних статтях Конвенції про захист прав людини й основоположних свобод в контексті питання вакцинації населення.Розглянуто як ті статті, щодо порушення яких було подано скаргу до Європейського суду з прав людини, так і ті, які, на думку авторів, також можуть порушуватися в контексті справи.Окрема увага приділяється вже наявній до цього практиці Європейського суду з прав людини у справах, присвячених проведенню обов'язкових щеплень.Важливим є те, що серед вищезазначених рішень із приводу вакцинації розглядаються саме попередні рішення Європейського суду з прав людини проти України.У роботі автори намагалися викласти аспект розумності й доцільності обмеження державою певних прав особи (виходячи з розглянутого рішення Європейського суду з прав людини -права на освіту) й легітимності втручання в право на приватне життя в контексті статті 8 Конвенції про захист прав людини й основоположних свобод.Також під час розгляду питання автори дослідили професійне ставлення до рішення Європейського суду з прав людини про вакцинацію представниці від України в Європейському суді з прав людини, а також інших, компетентних в аспекті вакцинації та прав людини осіб.Окрім звернення до міжнародної судової практики, в статті проводиться огляд рішень Верховного суду у справах, пов'язаних з обмеженням прав дітей на відвідування закладів освіти у зв'язку з відсутністю в таких дітей обов'язкових щеплень.Ключові слова: вакцинація, щеплення, Європейський суд із прав людини, право на повагу до приватного життя, дискримінація.This article is intended to outline the specifics of the case law related to compulsory vaccination and expulsion of children from school due to the lack of vaccinations.The relevance of this research topic is primarily due to the fact that in the last few months, well-known national and international judicial institutions have begun to make decisions related to vaccination of the population.It is possible that such a rapid development of jurisprudence in this matter can be attributed to the spread of the coronavirus epidemic and the emergence of an appropriate vaccine.The study focuses on the case law of the European Court of Human Rights.In particular, an analysis of both outdated decisions of the European Court of Human Rights, and more modern.In addition, this paper focuses on the relevant articles of the Convention for the Protection of Human Rights and Fundamental Freedoms in the context of vaccination.Both those articles, the violation of which was the subject of a complaint to the European Court of Human Rights, and those which, in the opinion of the authors, may also be violated in the context of this case, are considered.Particular attention is paid to the existing case law of the European Court of Human Rights in cases involving mandatory vaccinations.It is important that, among the above-mentioned decisions on vaccination, special attention is paid to the previous decision of the European Court of Human Rights against Ukraine.In this paper, the authors tried to highlight the aspect of reasonableness and expediency of restricting certain rights of the person (based on the decision of the European Court of Human Rights -the right to education) and the legitimacy of interference with the right to privacy in the context of Art. 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms.Also, when considering this issue, the authors tried to highlight the professional attitude to the decision of the European Court of Human Rights on vaccination of a representative of Ukraine in the European Court of Human Rights, as well as other persons competent in vaccination and human rights.In addition to recourse to international jurisprudence, this article also reviews Supreme Court decisions in cases involving the restriction of children's right to attend educational institutions due to the lack of compulsory vaccinations for such children.
