Liabilities of Different Steps in the BitTorrent Stream

Facing the increasing network illegal file sharing through BitTorrent and alike, the EU law has no unified copyright law to regulate this issue. This paper analyzes relevant case laws, relevant legal regulations and the current situation of BitTorrent. Within the stream of the BitTorrent downloading. Each participant (such as end-users, BitTorrent service provider and Internet service provider) needs to bear different levels of legal responsibility under EU regulations. This paper found that the end-user should be responsible for infringing copyrights, the BitTorrent service providers need to avoiding the illegal file-sharing on the original servers or the platform itself, and the Internet service providers are obliged to provide infringers’ data to help copyright owners protect their rights.
