Enablement and Written Description

Abstract This chapter considers the birth and development of the patent specification as the chosen vessel for communicating an invention to the public, and the interpretation of the standards to which is it now held. It examines the genesis of, and recent developments in, the English and US patent jurisprudence and legislative initiatives concerning enablement, sufficiency, and written description, and considers how well the theoretical and policy justifications underlying the various disclosure requirements mesh with the law in practice.
