The Power of “Hate Speech” and What, if Any, Limits Should Be Imposed on Free Speech in the Context of Extremism

Amos N. Guiora · Oxford University Press eBooks · 2014

This chapter considers the question of whether free speech should be limited in the face of extremist incitement. It begins with a discussion of the tension between free speech in Israel and the price paid for that right. In so doing, it presents the realities of the free speech dilemma; the discussion, with respect to Israel, is not abstract, for a terrible price was paid for tolerating incitement and intolerance. The chapter also examines free speech from the perspective of philosophers; free speech in the US; American free speech jurisprudence; and free speech in the UK, the Netherlands, and Norway.
