On Reconstruction of the Provision on "Corporate Works"

Wang Qian · Legal Forum · 2007

The Copyright Law provides different rules of copyright ownership for two distinctive types of works: corporate works and special works made for hire. As a consequence in practice, it is very difficult to distinguish corporate works from special works made for hire. The provision on corporate works should be reconstructed. The rule of copyright ownership for commissioned works and special works made for hire should be applied to corporate works. The law should also specify situations where the natural author of a corporate work waives his right of attribution.
