On the Idea Reconstruction of Copyrights Protection in the Digital Era

This dissertation analyzes challenges to the copyrights laws by three types of duplication:temporary duplication;individual duplication and searching-driven duplication by digital library.The modification of particular provisions can not fundamentally solve the newly emerged issues on duplication,since the traditional theories attempted to defend for the duplication from the perspective of reasonable utilization to prove its justifiability.However,from a new perspective,this dissertation undertakes the discussion on reforming the basic ideas of protecting copyrights,holding that the copyrights protection focus in the era of information network should transfer from the duplication rights to the information dissemination rights in order to construct the copyrights protection system centered on information dissemination.
