Research on the Criminal Law Problems of Network Larceny

Network larceny is a kind of familiar network crime.At present,network thieves and burglars case always happen,but because the legal provisions about this are not perfect,the judicial and academic circles usually have disputes over the characterization of network larceny.This text mainly discusses these problems,the definition and the constitution of the crime,the crime's judicial notice,whether electronic capital or currency can be the furtum,the problem of stealing valuable information service of computer information network corporations,the determination of fictitious property,the amount determination and malicious withdrawal by ATM,etc.At last,the author puts forward some legislative suggestion.
