The Exploration on validity of Evidence from Cellphone Message

Since evidence is the basis and core of criminal procedure,the legality of evidence is the determinative factor in order to achieve the objectives of criminal litigation.With the progress of social and technical development,mobile phone messages are extensively manipulated to committing a crime.However,there has been discussion about whether mobile phone message can be taken as evidence in criminal procedure.Based on the theory of criminal litigation and the principle,nature and characteristic of the practice of mobile phone message,this article explores the category of evidence which mobile phone message should belong to,how to take the evidence of mobile phone message and how to cross-examine this kind of evidence,etc.
