The development of the network technology changes the way that people use the works and challenges the system of the fair dealing of the copyright enormously. Whether the traditional、fair dealing remains “fair” under the environment of network becomes a problem that must be faced to now. Beginning with the meaning and the judgment standard of the fair dealing, This paper analyses the relation between the new way of the use of the works and the fair dealing under the environment of the network, and it also discusses the question that the system of the fair dealing of the copyright how to transform to the legal permission mode under the environment of network.
