Legislative Study on Database Protection in Germany and Its Enlightenment on China's Legislation for Database Protection

Sci-tech progress makes database industry develop rapidly.The current legislation for database protection in various countries is exceptionally rigorous.The technological features of database its own cause the database vulnerable to copy violations.Therefore,it is very necessary and urgent to make the legislation for database protection.In China,those databases with originality are protected by using copyright mode,and a large numbers of databases without originality are protected with the assistance of contract law,tort law and anti-unfair competition law.Such protection efforts make against the development of database industry.Germany's neibouring rights protection for database is a beneficial attempt to the legislation of database protection.China should borrow ideas from Germany's measures for amending and perfecting the legislation for database protection.
