Research on Preservation of SMS Evidence

Disagreement regarding whether the short messaging service(SMS) could become legal evidence has been existing between judicial circles and professionals,so in this paper,we focus on the issue of how to ensure the evidential effect of short message of mobile phone.The preservation of SMS evidence is a significant method to guarantee the effectiveness of SMS evidence.Besides doing theoretical research on the preservation subject and object of SMS evidence,we also conduct an experiment based on the preservation procedures and methods of SMS evidence from the Evidence Preservation Office of Chongqing University.Our goal is to change the awkward situation that it is easy to collect but hard to use SMS evidence,and to ensure its evidentiary effect.
