Analysis on the Legal Setting of Network Publishers Exclusive Rights

Administrative regulation confirms that the network information service providers may become the internet publishing agencies, which doesn't clear the nature of the network copyright. Unlike traditional publishing rights, it is in close proximity to information network spreading right, but is not exactly the same. From the perspective of necessity, legitimacy and compliance, the network copyrights should be the independent private right. Considering the conflicts of interests of different subjects between traditional publishing and network communication, the paper suggests the traditional publishing and network publishing can be unified as the publisher exclusive rights, while the right of choosing distribution environment of the author should be reserved.
