On several fundamental issues of Droit de Suite—as an opportunity to the amendment of Copyright Law

China's Copyright Law,which is in the process of being revised,first stipulates the system of Droit de Suite.Before the formal introduction of Droit de Suite system,it is necessary to study its nature,subject,object and right content.In terms of its nature,Droit de Suite is not a specific right of the copyright,but according to the connection between Droit de Suite and work,it should be included in the Copyright Law.In terms of its subject,its right subject should be the author or his successor or legatee,and its duty subject should be the seller who sells the works,while assignee or middlemen shall not bear joint and several liabilities.From the view of its object,the object of Droit de Suite should be limited to the original works of fine art,architecture design,the original model.In addition,the right of Droit de Suite contains the spirit right and property right.
