An Analysis of the Web Law on the Basis of Legal Philosophy

The development of the Web has brought about many problems which have thus far been discussed only in departmental laws and neglected from the viewpoint of the legal philosophy. The present paper, based on a thorough study of the problem in the light of the philosophy of law and the ambiguity of boundaries of domains, proposes that the fuzzy boundary between the private domain and the public domain in the milieu of the web is the main cause of the conflicts of rights on the web, concluding with some attempted measures that the author believes may contribute to the solution of the problem.
