Sentencing by computer,which is a new kind of sentence that can be used as the current sentencing patterns and methods,helps to improve the efficiency of sentencing,to a certain extent.It can both prevent the abuse of the sentence judge discretion to exclude those effects and contribute to a fair sentencing judge human factors and political factors,and ultimately promote China′s sentencing guidance system being established.The emergence of sentencing by computer does not mean that it can completely replace the sentencing judge and become an independent subject.In terms of its actually functions,the computer sentencing discretion of judges is only an assistant means of punishment or just an attempt to court office automation.
