Rejecting Privilege against Self-incrimination and the Right to Silence

With the democratization and scientificity of litigation going further , jurists have been focusing on the two issues of rejecting privilege against self-incrimination and the right to silence. However, their relationship seems indistinct in theory level. This paper analyses several theories on their relationships and then gives a further study just to make up for the theory and then it can well guide the practice .
