On the Original Theories of Electronic Evidence

rule is an ancient but important evidence rule.How can it be used to the newly electronic evidence? What is the original standard of this evidence? This article starts with an analysis of a discussion from Original Medium Theory to Original Nihilism in China,introduces and compares the mainly theories in foreign countries and international organizations,such as Functional-equivalence Principle,Fictional Doctrine,Mixture Standards Doctrine,Double-original Doctrine,and Conjoint-printings Doctrine.In the final section,this article focuses on how to create Chinese original theories of electronic evidence.It draws a conclusion that China may develop a variety of integrative theories in view of electronic evidence's multiple.
