Rational Ponderation over the Right of Silence

The right of silence is an emergency problem which is neglected in criminal legislation in our country. The reason is that, as contrary to the right of silence, rooted in religous propitiation and state departmentalism, the principle of self incrimination neglects the protection of criminal suspects and defendants' right. To overcome the problem effectively, it is necessary to establish the right of silence, it is not only an ethical foundation of human and humanitarianism as well as self departmentalism in the political conviction of the civil society, but also the justice of judicial process.
