Comparative Study of Objective Extra Factors

Some provisions of the Criminal Law of China have some puzzling and complicated problems about an offence,that is,the forms of an offence of a charge which stipulated in one legal provision include negligent and intentional aspects.In order to solve this problem,Mr.Chu Huaizhi and Yang Wenshu put forward the theory of compound forms of an offence,while Mr.Zhang Mingkai advances the concept of objective extra factors.This paper discusses that the concept of objective extra factors is practi-cal and valuable in theoretical study and legislation.
