Challenge and Strategy of Personal Duplication on Copyright System in Network Environment

The economic attribute and technological feature of duplication totally change with the development and popularity of digital and network technology,and possibility of personal duplication increases greatly.Personal duplication,as a typical fair use clause,severely infringes copyrighters' interests in the network environment,so its legitimacy is questioned,and it needs to be relocated.In conclusion,China should make a law on personal duplication by three-step testing standards,exclude individual appreciation out of fair use,clarify the illegal behavior of downloading and transmitting others' works,establish copyright compensation system to balance the interests between copyrighters and users.
