Retrospect and Prospect of Copyright Protection for Computer Software in China

The paper employs the legislation basis、the legislation mode and the system of laws and regulations of copyright protection for computer software in China,reviews the legislation history,emphasizes the influence of external expressure on the legislation of interllectual property in China,especially introduces the two rounds of controversies in China over the legal liability of using unauthorized software by end-users,elaborates the views on legislation of intellectual property protection for computer software in the near future,stresses that the lnhibition Theory,rather than Replication Theory,should be the basis of the solutions to the issue of software end-users,suggests that abolish the present legislation mode which makes administrative regulations separatly from Copyright Law to regulate the protection for computer software,and add certain provisions directly into the Copyright Law to protect computer software.
