The Legal Modernization Course of China Viewed from the Evolution of the Institution of Land Property Right——Statute-based Analysis

paper analyzes the institution of land property right from Western Zhou Dynasty to the Republic of China,mainly revolving around the institution of land property right at the end of Qing Dynasty and the period of the Republic of China.It shows the establishment of the institution of land property right in modern from three periods:the late Qing Dynasty(1901-1911),the Beijing National Government of the Republic of China(1912-1927),the Nanjing National Government of the Republic of China(1928-1949).Through the analysis of ancient codes in past dynasties and some specific provisions like Active Criminal Law of Qing Dynasty,Civil Law Draft of Qing Dynasty,Civil Law Draft of the Republic of China and The book of the Chinese Supreme Court Decisions,this paper reflects the legal modernization course of from the viewpoint of land institution in modern China.
