On Sample Evidence in Criminal Proceedings

When it is difficult to prepare evidence in criminal proceedings due to the large amount of homogeneous evidence,and when the difficulty can not be resolved by constructive methods,sample evidence method can apply on the condition that such method does not reduce the standard of evidence and the evidence resources are limited. In criminal proceedings,the following methods can be used: simple random sampling,systematic sampling and stratified sampling. Sample evidence is one of the forces used by the judge to determine facts about the case. The conditions for sample evidence to be effective are as follows: the sample is to be derived from the total of homogeneous evidence,the sampling method shall be scientific,the process shall be standardized,and the result shall be accurate. Statistical error may affect the evidence effectiveness of sample evidence.
