On the Identification of the Right of Publication

The right of publication is one of the moral rights of an author. It is about the determination of the author, whether his work is published or not. Is anyone still infringe the right of publication, if he use the work without the license of the author after the author has first exercised the right of publication? This article will discuss according to the newly amended the Copyright Law of China the questions that arise from a case, such as, the identification of the contents, the infringement and infringement liability of the right of publication, in order to get a complete comprehension of this right.
