Views On Transaction between Penalty and Compensation Based on Game Theory

Transaction between penalty and compensation refers to mutual transformation between civil liability and criminal liability which is in essence a gaming among the state, the victim and the offender. While satisfing the victim's desire for compensation, the offender obtains the opportunity to get lenient punishment, the state saves execution resources as well. To make this game achieve maximum benefits, we should clarify the main interest and benefit claim of each subject concerned in this game and then design it in a model similar tooffer and acceptancein a contract.
