According to Item 3,Article 196 of Criminal Law of China:Whoever steals a credit card and uses it shall be convicted and punished in accordance with provisions in Article 264 of this Law. It is obvious that the action of stealing credit card to use should be punished by theft crime.But there are disputes in theory and practice that how to conform action of stealing credit card to use.
