Criminal Liability of the Act of Drawing Cash from ATM with a Picked-up Credit Card

The act of drawing cash from ATM with a picked-up credit card occurs from time to time,while the criminal law and justice have different understanding on the act.The author analyzes the act on the basis of the criminal law and thinks the act of drawing cash from ATM with a picked-up credit card is not the crime of encroachment and theft and should be the crime of fraud.Meanwhile,because the relationship between the credit card fraud and the crime of fraud is the relationship between special legal items and general legal items,the act should be the credit card fraud.
