Research on the Definition of Computer Software Copyright Tort

In the information times,the computer exploiting ability is a important symbol of a country's competition.In china,the copyright of computer software is been protected by law.But in the justice practice,it is always a difficult things to definite the computer software copyright tort.On the basis of international related theories and pratices,this thesis discussed the main methods,including idea/expression dichotomy,substantial similar+touch+exclusion of reasonable explanation and abstract-filter-compare three steps.Then,this thesis discussed the right limitation of computer software copyright.
