Study on the Theory of Objective Imputation

The theory of objective imputation belongs to theory of substantial constitutive requirements. Whether the danger prohibited is realized or not is an estimate whose object is the constitutive results. Therefore,subordinating to the rule of realization of danger prohibited, the theory of the protective scope of rules is also aimed at the verification of constitutive results. To affirm negligent crime correctly, especially the negligent traffic crime, the judge must estimate whether the results are under the protective scope of rules.
