Discussion on the Regulation of Secondary Uses of Phonograms

Referring to the legislative information of PRC Copyright Law,this paper analyses the regulation of secondary uses of phonograms in PRC Copyright Law,and points out the fact that no rules are made in the relationships between the broadcasting organizations and the performers and producers of phonograms in the secondary uses of phonograms should not be regarded as a legal leak,but an intentional arrangement of the legislators,who want to protect the broadcasting organizations against legal obligations to the performers and producers of phonograms in the secondary uses of phonograms.This article also criticizes the regulation of secondary uses of phonograms in PRC Copyright Law,and offers suggestions on the revision of PRC Copyright Law.
